Unsafe property and serious injuries

California premises liability and slip-and-fall claims

Practical guide: What evidence should you preserve after a fall in a California store?

A fall in a store, a broken stairway, or a falling object can cause lasting harm. DFG LAW, APC helps people injured by unsafe property conditions throughout California. We investigate who controlled the property, what made it dangerous, and whether reasonable precautions could have prevented the injury.

A property injury does not automatically establish liability. A claim generally requires proof of negligent use or maintenance, harm, and a causal connection. Public property cases follow additional rules. See California Civil Jury Instruction 1000.

Slip, Trip, and Fall Claims

Spills, uneven walking surfaces, damaged stairs, and objects in walkways may cause a fall. The investigation should identify the specific condition and how it caused the injury. When possible, photograph the hazard and surrounding area, note the time, and obtain witness contact information.

Report the incident to the business or property manager and keep a copy of any report you receive. Save your footwear and original photographs. Surveillance footage may be overwritten, making an early preservation request important.

Notice, inspections, and maintenance

A central question is often whether the responsible party knew, or should reasonably have discovered, the unsafe condition in time to address it. Inspection schedules, cleaning records, prior complaints, and employee observations may matter. A warning sign is one fact to evaluate, not an automatic answer.

See California Civil Jury Instruction 1003 on unsafe conditions.

Falling Objects

Falling merchandise, unsecured fixtures, or tree limbs can raise different questions from a floor-level hazard. We review maintenance history, earlier warnings, photographs, and who had responsibility for inspection or repair. The nature of the hazard determines which records and expert analysis may be useful.

Malfunctioning Equipment

An elevator, escalator, gate, or other equipment malfunction may require investigation of both the property operator and a maintenance contractor. Identify the equipment and preserve service records when available. Responsibility depends on the evidence; an injury alone does not establish a defect or negligent maintenance.

Parking Lot or Parking Structure Incidents

Parking areas can present uneven pavement, inadequate lighting, wheel stops, or other conditions. Photographs should show both the close-up hazard and the surrounding route. Property ownership, management responsibilities, and the visibility of the condition can affect the analysis.

Construction Sites

Construction-related injuries may involve multiple businesses and overlapping responsibilities. If the incident occurred while you were working, workers’ compensation and a possible claim against another party require separate review. Tell us who employed you, where you were working, and which companies were involved.

Building and documenting your claim

Attorney David F. Garcia’s background representing insurers and corporations informs how DFG LAW, APC evaluates disputed liability and damages. We focus on preserving evidence, identifying the responsible parties, and documenting the medical and financial effects of the injury.

Keep medical records, bills, wage information, and communications from insurers. We can discuss what additional material may be needed and whether expert review would assist the case.

Contact the firm promptly so the deadlines and evidence can be assessed. Claims involving government property can require an earlier administrative claim; the applicable process depends on the facts. Do not assume the same deadline applies to every accident.
